A Political Contrivance

Republican state legislators in Pennsylvania are pushing a scheme that, if GOPers in other states follow their lead, could cause President Barack Obama to lose the 2012 election — not because of the vote count, but because of new rules. That's not all: There's no legal way for Democrats to stop them.

The problem for Obama, and the opportunity for Republicans, is the electoral college. Every political junkie knows that the presidential election isn't a truly national contest; it's a state-by-state fight, and each state is worth a number of electoral votes equal to the size of the state's congressional delegation. (The District of Columbia also gets three votes.) There are 538 electoral votes up for grabs; win 270, and you're the president.

Here's the rub, though: Each state gets to determine how its electoral votes are allocated. Currently, 48 states and DC use a winner-take-all system in which the candidate who wins the popular vote in the state gets all of its electoral votes. Under the Republican plan — which has been endorsed by top GOPers in both houses of the state Legislature, as well as the governor, Tom Corbett — Pennsylvania would change from this system to one where each congressional district gets its own electoral vote. (Two electoral votes — one for each of the state's two senators — would go to the statewide winner.)

This could cost Obama dearly.

In my book, ALL electoral college votes would be assigned proportionally. For me, that is the most fair way to do it. It's certainly NOT the same thing as proportional representation -- something I strongly favor -- but it's a start in that direction.

But this plan from the GOP is not about fairness; it's about impacting a particular election in a way that benefits those making the proposal! If the GOP believed that their state would swing Republican, you wouldn't hear as much as a peep out of them.

And so what we have here, in my opinion, is a good proposal for the wrong reason. In this instance, the reason is crass self-interest.

  1. Any state that enacts the proportional approach on its own would reduce its own influence. This was the most telling argument that caused Colorado voters to agree with Republican Governor Owens and to reject this proposal in November 2004 by a two-to-one margin.

    If the proportional approach were implemented by a state, on its own,, it would have to allocate its electoral votes in whole numbers. If a current battleground state were to change its winner-take-all statute to a proportional method for awarding electoral votes, presidential candidates would pay less attention to that state because only one electoral vote would probably be at stake in the state.

    The proportional method also could result in third party candidates winning electoral votes that would deny either major party candidate the necessary majority vote of electors and throw the process into Congress to decide.

    If the whole-number proportional approach had been in use throughout the country in the nation’s closest recent presidential election (2000), it would not have awarded the most electoral votes to the candidate receiving the most popular votes nationwide. Instead, the result would have been a tie of 269–269 in the electoral vote, even though Al Gore led by 537,179 popular votes across the nation. The presidential election would have been thrown into Congress to decide and resulted in the election of the second-place candidate in terms of the national popular vote.

    A system in which electoral votes are divided proportionally by state would not accurately reflect the nationwide popular vote and would not make every vote equal.

    It would penalize states, such as Montana, that have only one U.S. Representative even though it has almost three times more population than other small states with one congressman. It would penalize fast-growing states that do not receive any increase in their number of electoral votes until after the next federal census. It would penalize states with high voter turnout (e.g., Utah, Oregon).

    Moreover, the fractional proportional allocation approach does not assure election of the winner of the nationwide popular vote. In 2000, for example, it would have resulted in the election of the second-place candidate.

    A national popular vote is the way to make every person's vote equal and guarantee that the candidate who gets the most votes in all 50 states becomes President.

  2. You made some points that are good food for thought! I will say that the chief problem with a national popular vote is that it shortchanges small population states as much as any other system. Why would any presidential candidate really care how the people in Wyoming or Alaska cast their votes?

  3. Now political clout comes from being a battleground state.

    Now with state-by-state winner-take-all laws presidential elections ignore 12 of the 13 lowest population states (3-4 electoral votes), that are almost invariably non-competitive, and ignored, in presidential elections. Six regularly vote Republican (Alaska, Idaho, Montana, Wyoming, North Dakota, and South Dakota), and six regularly vote Democratic (Rhode Island, Delaware, Hawaii, Vermont, Maine, and DC) in presidential elections.

    Support for a national popular vote is strong in every smallest state surveyed in recent polls among Republican voters, Democratic voters, and independent voters, as well as every demographic group. Support in smaller states (3 to 5 electoral votes): Alaska -- 70%, DC -- 76%, Delaware --75%, Idaho – 77%, Maine -- 77%, Montana – 72%, Nebraska -- 74%, New Hampshire --69%, Nevada -- 72%, New Mexico -- 76%, Oklahoma – 81%, Rhode Island -- 74%, South Dakota – 71%, Utah - 70%, Vermont -- 75%, and West Virginia – 81%, and Wyoming – 69%.

    Nine state legislative chambers in the lowest population states have passed the National Popular Vote bill. It has been enacted by the District of Columbia, Hawaii, and Vermont.

  4. That's interesting. I can't imagine why voters in those states would think that it was such a good idea. If they feel neglected now, it wouldn't be any better -- and probably much worse -- under a straight up-and-down vote.

  5. Come the end of voting on Election Day, most voters don't care whether their presidential candidate wins or loses in their state . . . they care whether he/she wins the White House. Voters want to know, that even if they were on the losing side, their vote actually was directly and equally counted and mattered to their candidate. Most Americans consider the idea of the candidate with the most popular votes being declared a loser detestable. We don't allow this in any other election in our representative republic.
